Terms of Service

These terms of service ("Terms") govern your use of the PopTutor mobile application and the poptutor.app website (collectively, the "Service"), operated by Motho Cloud Services, a company registered in Sweden. By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using PopTutor, you confirm that you have read, understood, and agree to these Terms. If you do not agree to these Terms, you must not use the Service.

2. Description of the Service

PopTutor is a study tool that uses artificial intelligence to generate quiz questions from user-provided study materials such as photographs, images, and PDF documents. The Service includes features such as spaced repetition, progress tracking, and study groups. The Service is offered as a free, ad-supported version.

3. AI-Generated Content

PopTutor uses artificial intelligence (Azure OpenAI) to analyze uploaded study material and generate quiz questions, answer alternatives, and explanations. AI may misinterpret the uploaded material and, as a result, generate questions with incorrect answers or inaccurate explanations. The AI-generated content is provided "as is" and Motho Cloud Services makes no warranties regarding the accuracy, completeness, or reliability of any AI-generated content.

4. User Responsibility

You are solely responsible for verifying that AI-generated quiz questions, answers, and explanations are correct before relying on them for study or any other purpose. PopTutor is intended as a supplementary study aid and should not be used as the sole source of information for academic assessments, professional examinations, or other critical decisions. You are also responsible for ensuring that the material you upload does not infringe on any third-party intellectual property rights.

5. Advertising

The free version of PopTutor is ad-supported. Advertisements are displayed after completed quizzes. By using the free version, you agree to the display of advertisements. The content and frequency of advertisements is determined at our discretion and may change without prior notice.

6. Intellectual Property

All content, design, code, and trademarks associated with PopTutor are the property of Motho Cloud Services or its licensors. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent. The study material you upload remains your property; by using the Service, you grant us a limited, temporary license to process your material solely for the purpose of generating quiz questions.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Motho Cloud Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, academic results, or profits, arising from your use of or inability to use the Service. This includes, without limitation, any damages resulting from reliance on AI-generated content. Our total liability for any claim arising from these Terms shall not exceed the amount you have paid us in the twelve months preceding the claim.

8. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service and delete the application at any time. Upon termination, your locally stored data remains on your device until you delete it.

9. Changes to These Terms

We may update these Terms from time to time. Any changes will be published on this page with a revised "last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms. We recommend reviewing these Terms periodically.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Sweden. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the Swedish courts.
